General. Please read these Terms of Use (“Terms”) carefully, as they constitute a legal agreement between the University of Kansas (“University”), and you. By accessing this website (“Website”), you are agreeing to be bound by these Terms, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these Terms, you are prohibited from using or accessing the Website. The materials contained on this Website are protected by applicable copyright and trademark laws. Additional information governing use of this Website is contained in our Privacy Policy.
Use License. Permission is granted to view materials on the Website for personal, non-commercial transitory use only. This is the grant of a license, not a transfer of title. Under this license you may not: modify or copy the materials; use the materials for any commercial purpose; attempt to decompile or reverse-engineer any software contained on the Website; remove any copyright or other proprietary notations from materials; transfer materials to another person or “mirror” the materials on any other server; tamper with Website code; deliberately transfer viruses or harmful code or other damaging materials to the Website; or behave in harassing ways to other users of the Website. User Generated Content. If you upload, post or submit any content on the Website, you represent and warrant that you have all the necessary legal rights to upload, post or submit such content and it will not violate any law or the rights of any person. You further agree that the University and those authorized by the University have your permission to use it for any educational, promotional, or other standard University purpose. You will not post content that is off-topic, or defamatory, libelous, threatening, or harassing in violation of state or federal law. You will not post content that discusses illegal activities with the intent to commit them. You will not post any content that infringes another’s intellectual property, including, but not limited to, copyrights, trademarks, or trade secrets. You agree that you are not under the age of 13 or have obtained permission from an adult before submitting content. You will not upload to, or distribute or otherwise publish on to the Website any malware, viruses, spyware, or other malicious software or files and will not use automated means to upload to, or distribute or otherwise publish content onto the Website.
You acknowledge that any submissions you make to the Website may be edited, removed, modified, published, transmitted, and displayed by the University and you waive any rights you may have in having the material altered or changed in a manner not agreeable to you. You grant the University a non-exclusive, perpetual, world-wide, royalty-free, sub-licensable license to the submissions, including the right for the University or any third party it designates, to use, copy, transmit, excerpt, publish, distribute, publicly display, publicly perform, communicate to the public, create derivative works of the submissions in any form or media now known or hereinafter developed. You are solely responsible for the content of your submissions. The University does not and cannot review every submission and is not responsible for their content, and the University reserves the right to delete, move, or edit submissions that it, in its sole discretion, deems abusive, defamatory, obscene, in violation of copyright or trademark laws, or in violation of these Terms.
Indemnification. You hereby agree to indemnify, defend and hold harmless the University of Kansas, the University, and all of their officers, directors, owners, agents, information providers, affiliates, licensors and licensees from and against any and all liability and costs, including, without limitation, reasonable attorneys’ fees, incurred in connection with any claim arising out of any breach by you of these Terms or the foregoing representations, warranties and covenants. You shall cooperate as fully as reasonably required in the defense of any such claim.
Revisions and Errata. The materials appearing on the Website could include technical, typographical or photographic errors. The University does not warrant that materials on the Website are accurate, complete or current. The University may make changes to the materials contained on the Website at any time without notice. The University does not, however, make any commitment to update the materials.
Links. The University has not reviewed all of the sites linked to the Website and is not responsible for the contents of any such linked sites. The inclusion of any link does not imply endorsement by the University of the site. Use of any such linked website is at the user’s own risk.
Site Terms of Use Modifications. We may revise these Terms at any time without notice. By using the Website you are agreeing to be bound by the then-current version of these Terms.
Governing Law. Any claim relating to the Website shall be governed by the laws of Kansas without regard to its conflict of law provisions.
Entire Agreement. This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all other prior agreements and understandings, both written and oral, between the parties with respect to the subject matter hereof. In the event that any provision of these Terms is held as unenforceable, it will not affect the enforceability of the remaining provisions.
